TERMS AND CONDITIONS: 1. Membership agreement: Giammalva Racquet Club Membership does not confer any ownership of proprietary interest in the physical assets, real property or operations of the club. 2. Resignation Agreement: It is agreed that Applicant may resign from the club after membership obligation by giving thirty (30) day written notice by certified mail to the club. The effective date of the resignation will be the date the club receives Applicant's written notice. All accrued dues and other charges for which Applicant is liable are due upon the effective date of resignation. 3. Liabilities Agreement: I am assuming no liabilities in connection with this membership other than for dues and charges incurred by me; my family or guests in the use of the Club and its facilities. I understand that Club amenities and services are subject to change at management's discretion. Applicant agrees that in the event of a corporate reorganization or personal divorce, this membership is not divisible and the membership shall be allocated by agreements of all claimants, or in the absence of agreement of all claimants, or in the absence of agreement, by court order. Such allocations are subject to the sole approval of Admissions. The successor to the Membership shall execute all necessary papers and pay all allocation fees required by the club. 4. Payment Agreement: Payment of account is due on receipt of the monthly statement. Applicant agrees to pay the account when due. Applicant agrees that the Club may assess a late charge of $15.00 for past due accounts. Any discrepancy of the account must be acknowledged within sixty (60) days. Dues and other Club charges are considered luxuries under all applicable laws. I grant the club permission to charge my check/credit account listed on application for all dues and charge on my account sixty (60) days overdue and unpaid. Applicant agrees to pay all reasonable attorney fees, investigator fees and costs in the event this account is turned over for collection. The membership card shall remain the property of the club at all times and must be returned to the Club on demand. 5. Rules and Regulations Agreement: If accepted for membership at Giammalva Racquet Club, I agree to comply with all Club rules and regulations that are now in effect, as well as those that maybe adopted by the club. I understand that my failure to comply with such rules and regulations may result in suspension from active membership on a temporary or permanent basis, as may be determined by the Club and at its sole discretion. 6. Disclaimer and Hold Harmless Agreement: I accept full responsibility for my use, heirs and assigns use apparatus, appliances, faculty privilege or service whatsoever, owned and operated by the club, at my own risk, and shall hold this Club, its shareholders, directors, officers, employees, representatives, and agents harmless for any and all negligence, loss, clam, injury, damage, or liability sustained or incurred by me resulting therefrom.
